General Terms and Conditions of ZE Entertainment GmbH, Letzigraben 144, 8047 Zurich, Switzerland

Validity vis-à-vis entrepreneurs and definitions of terms

The following General Terms and Conditions apply to all orders between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his or her commercial nor to his or her independent professional activity (§ 13 BGB).

 

Conclusion of a contract, storage of the text of the contract

The following regulations on the conclusion of contracts apply to orders placed via our website https://urbanmissions.games. By placing an order, the participant accepts the general terms and conditions of ZE Entertainment GmbH. An order is only valid when it is confirmed by ZE Entertainment GmbH by email.

In the case of an order, the contract is concluded with

The presentation of the offers on our website does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to place orders. By ordering the desired event, the consumer submits a binding offer to conclude a purchase contract.

When an order is received on our website, the following rules apply:

The consumer makes a binding offer to enter into a contract by successfully completing the order procedure provided in our online shop.

The order is placed in the following steps:

  1. Selection of the desired offer
  2. Pressing the “Order” button
  3. Entering all personal data, e.g. first name, last name, address, telephone number, email address
  4. Entering the number of players, number of teams and team name(s)
  5. Possible entry of a voucher code
  6. Reading and confirmation of acceptance of the General Terms and Conditions of ZE Entertainment GmbH
  7. Binding confirmation of the order by clicking the “Buy” button
  8. Selection of the desired payment method
  9. Payment with the selected payment method

Before bindingly sending the reservation, the consumer can, after checking his details, return to the Internet page on which the customer’s details are recorded and correct input errors by pressing the “Back” button contained in the Internet browser he is using or cancel the reservation process by closing the Internet browser.

We confirm receipt of the order immediately by means of an automatically generated e-mail (“order confirmation”).

Storage of the contract text for orders on our website: We store the contract text and send you the order data.

 

Prices, payment, due date

The prices for the orders are noted online or, if applicable, are agreed directly with the participants for larger groups. Unless otherwise agreed, prices are per person in Swiss francs (CHF) or in Euro.

The prices quoted include the statutory value-added tax.

The consumer has the option of ordering and paying for games only online via urbanmissions.games. There is no possibility of paying the amount in cash at the start of the booked event.

 

Right of cancellation of the customer as a consumer

A cancellation can only be made by e-mail: info@urbanescape.ch.

Please include the following details in the email; it is best to reply to the confirmation email of your order:

  • Your full name
  • Name of the game
  • Explanation of the reason why you want to cancel the game

A cancellation of a game can only take place under the following conditions:

  • in case of one delivered voucher code per game: the delivered voucher code has not been redeemed in the URBANmission app yet
  • in case of more than one delivered voucher code per game: none of the voucher codes has not yet been redeemed in the URBANmission app. if at least one voucher code has already been redeemed in the URBANmission app, the cancellation is not possible
  • it takes place within 14 days from the date of purchase

Exchange

An exchange can only be made by email: info@urbanescape.ch.

Please include the following details in the email; it is best to reply to the confirmation email of your order:

  • Your full name
  • Order number
  • Name of the old game
  • Name of the new game

An exchange means that you want to replace the purchased game with another game.

An exchange of a game can take place only under the following conditions:

  • in case of one delivered voucher code per game: the delivered voucher code has not been redeemed in the URBANmission app yet
  • in case of more than one delivered voucher code per game: none of the voucher codes has not yet been redeemed in the URBANmission app. If at least one voucher code has already been redeemed in the URBANmission app, the game can no longer be exchanged.

An exchange will take place under the following conditions:

  • If the price of the game that will be exchanged is cheaper than the price of the new game, the difference in price will be paid by the customer before the exchange is made
  • If the price of the game to be exchanged is more expensive than the price of the new game, the customer will receive the price difference in the form of a voucher.

Change of the number of players

Changing the number of players can be done only by e-mail: info@urbanescape.ch.

Please include the following details in the e-mail; it is best to reply to the confirmation e-mail of your order:

  • Your full name
  • Order number
  • Number of players booked
  • Number of new players

A change in the number of players – a decrease in the number of players – can only take place under the following conditions:

  • in case of one delivered voucher code per game: the delivered voucher code has not been redeemed in the URBANmission app yet
  • in case of more than one delivered voucher code per game: none of the voucher codes has not been redeemed in the URBANmission app yet. If at least one voucher code has already been redeemed in the URBANmission app, the number of players can no longer be reduced.

The customer will receive a voucher in the value of the prize for the people who will not participate.

A change in the number of players – an increase in the number of players – must be communicated to us at least one working day before the planned game, so that the change can be processed. The additional amount for the new players must be paid before the game.

Warranty and punctuality

The statutory warranty regulations apply.

Our services result from the service description according to the website. Special requests on the part of the participants or ancillary agreements are only part of the contract if they have been confirmed in writing and without reservation by the booking office.

The services of ZE Entertainment GmbH begin with the arrival of the participants at the location of the ordered game.

Each participant is responsible for their own arrival and simultaneous arrival.

 

Terms of use

Participation is at the participant’s own risk. Insurance is the responsibility of the participants or the legal representatives of the participants if they are minors. Participants are fully liable for all damage to equipment and objects caused by them.

 

Secrecy

It is expressly not permitted to publish and/or copy for commercial purposes content such as puzzle ideas, game sequences, brainteasers, puzzles, solution approaches, secret hiding places or the like and/or to apply them in part at another location without the permission of ZE Entertainment GmbH.

 

Changes to the programme on the part of ZE Entertainment GmbH

ZE Entertainment GmbH reserves the right to make minor changes to the services. This has no influence on the validity or the content of the present subject matter of the contract.

 

Force majeure

If the event has to be cancelled due to force majeure, there is no entitlement to compensation. Force majeure are events that ZE Entertainment GmbH could neither foresee nor avert. These include in particular: war, terrorism, political unrest, natural disasters, nuclear events, fire/water damage or similar events.

 

Liability

Insurance is the responsibility of the participants. ZE Entertainment GmbH ensures that the agreed services are provided with reasonable care and appropriate knowledge.

 

Disclaimer

ZE Entertainment GmbH accepts no liability for direct or indirect damages such as injuries of any kind, deaths, losses (e.g. pleasure not felt) or similar. Neither does ZE Entertainment GmbH accept responsibility for claims of any kind that are due to the actions of the participants or a third party or that follow from events that were not foreseeable or avoidable (force majeure).

 

Applicable law and place of jurisdiction

The exclusive place of jurisdiction for any disputes is the registered office of ZE Entertainment GmbH. Swiss law is exclusively applicable.
